These terms and conditions of sale (hereinafter, “Terms and Conditions”) apply to all sales of products (hereinafter, “Products” or “Product”) purchased through the website www.vladishoes.it (hereinafter the “Website”).
The use of the service of remote sales described in these Terms and Conditions is reserved exclusively for consumers (hereinafter, “Customers” or “Customer”), defined as the natural person acting for purposes unrelated to his trade, business or professional activity. For these subjects there are partial exclusions provided, since the Consumer Code does not address this type of purchase. Please refer to the Consumer Code for any further information about this concept.
The language available for concluding the contract is Italian.
The Customer is required to read the Terms and Conditions that have been made available on the Website, in order to give consent to the storage and reproduction of said document on behalf of the Customer, in accordance with Article 12 of Italian Legislative Decree no. 70 of 9 April 2003.
The contracts concluded with Bagi S.r.l. (as defined below) through the Website are regulated by Italian law and, in particular, by Italian Legislative Decree no. 2016 of 6 September 2005 (“Consumer Code”) and Legislative Decree 9 April 2003, n. 70 (hereinafter, “Ecommerce Act”).

Information relating to the Products of “Bagi S.r.l.” subject to remote selling through the Website are available, with their product codes, on the Website.
The above information is provided in accordance with Articles 52 and 53 of the Consumer Code.
II product prices are include all taxes and fees. Shipping costs are shown as a separate item and are included in the total to pay. All prices are in Euros.
The essential features and prices of the products are given in the offer for each Product.
Before submitting the order the customer will have the opportunity to correct any errors in data entry by following the appropriate procedure for modification provided by the Website. In particular, the Customer has the right to change the amount of products to be purchased by adding or deleting one or more Products from the “shopping cart”.
By placing an order, the Customer acknowledges and declares to have read all the instructions provided to him/her during the purchase procedure and to accept the Terms and Conditions.
The customer will have the opportunity to view and follow the status of his/her order in the “Orders” section of his/her account.
Bagi S.r.l. It reserves the right to evaluate the acceptance of orders received. Bagi S.r.l. will notify the Customer of any eventual inability of accepting the orders received within 30 days from the day following that on which the customer sent the order to Bagi S.r.l.and will refund any amounts already paid by the customer for payment of the supply.
The Customer may pay for the Products and the shipping expenses by credit card, bank transfer and PayPal.
No charge will be made at the moment when the order is placed, except for the expenditure necessary to validate the data of the credit card which will then be immediately refunded.
Bagi S.r.l. also accepts payments made by bank transfer. Eventual bank charges will then be at the expese of the Customer.
In the event that, for whatever reason, payment of the amounts due from the Customer cannot be carried out, the sales process will be automatically stopped and the sale will be automatically cancelled.
In accordance with the provisions of Article 53 of the Italian Consumer Code, upon execution of the contract, the Customer will recieve a confirmation of receipt, by email, of the order placed by the Customer. This email will contain a summary of the Terms & Conditions, the essential features of the product ordered, its price, the amount paid, the existence of the right of withdrawal – with an indication of the time periods and process for returning the good if necessary – the geographical address for the purpose of submitting any eventual complaints or information about the support services and existing warrantees.
No contract shall be concluded between Bagi S.r.l. and the Customer when Bagi S.r.l. has reasonable grounds to believe that the Customer is not operating on the basis of an effective and genuine interest in the purchase of the products ordered, or that the Customer is exercising the right of withdrawal in an abusive manner, as recognized in Article 12 below.
In such cases, the order submitted by the Customer shall be of no effect whatsoever. Bagi S.r.l. will send the Customer, via e-mail, a notice stating the failure to conclude the contract, while also ensuring the cancellation of any debits and/or charges made to the Customer.
The Products purchased on the Website will be delivered to the address specified by the Customer. The Customer has, in any case, the right to request the delivery of the Products to a person of his choice, whose residence or domicile is within the Italian territory. A signature of an adult older than 18 will be required upon delivery. Delivery will not be made to PO boxes.
For each order completed on the Website, Bagi S.r.l. issues an invoice for the goods shipped, sending it via e-mail or mail to the Customer who placed the order, in accordance with the Italian Presidential Decree 445/2000 and with Italian Legislative Decree no. 52/2004. For the issuance of the invoice only the information supplied by the Customer during the order process will be used. It will not be possible to make any changes to the invoice after the issuance thereof.
Shipping costs shall be charged to the Customer and are clearly indicated on the Website and in the order form.
All purchases will be delivered by the express delivery service chosen by the Customer during the purchase process from the services proposed by Bagi S.r.l. (hereinafter, “Courier”) from Monday to Friday, excluding public holidays and national holidays. Bagi S.r.l. is not responsible for unpredictable delays.
Bagi S.r.l. will send the Customer an e-mail confirmation once the Products have been shipped, in which the tracking number of the shipment will be specified. Using this tracking number, the Customer will be able to enter the Curier’s site and view the shipping status.
Except in cases of extenuating or unforeseeable circumstances, in accordance to the Consumer Code, the Products will be delivered within a maximum of 30 (thirty) days from the day following that on which the Customer places the order with Bagi S.r.l. , unless Sport Nutrition International S.r.l. communicates – within the same time period, by e-mail – the inability to deliver the goods ordered, due to a sudden or temporary unavailability of the Products. In the event of such notification, Bagi S.r.l.will refund any amounts already paid by the Customer for payment of the supply.
In the event that, in response to the notification from Bagi S.r.l. of a delay in the delivery date, the Customer wishes to cancel the order, any amount already paid by said Customer will be refunded as soon as possible, but no later than 30 (thirty) days from the day following that on which the customer sent the order to Bagi S.r.l.
For the delivery of the goods, the presence of the Customer or his/her representative at the address indicated in the order is required. Upon delivery of the goods by the Courier, the Customer must check that the number of boxes is the same as indicated in the delivery note and that the package is intact or unaltered. Any damage to the package and/or the Products or any error in the number of packages should be immediately contested using the appropriate means in written form on the proof of delivery from the Courier. Once the delivery note from the Currier is signed, the customer will not be able to make any objection about the appearance of the parcel delivered.
Bagi S.r.l. wants to ensure complete Customer satisfaction.
According to Article 64 of the Italian Consumer Code, the Customer has the right to terminate the contract, without specifying any reason, by returning the Products purchased through the Website within 10 (ten) business days from the date of receipt of the Products.
The above communication can be sent, within the said period of 10 (ten) days, via e-mail, telegram and fax.
In case of exercising the right of withdrawal, Bagi S.r.l.will reimburse the full price of the Products provided that the Customer returns them in good condition and only if the return instructions above are followed correctly. Bagi S.r.l. reserves the right to refuse the return of those Products that do not conform to the aforementioned requirements. Refunds will be made by the same method of payment used for purchase.
Delivery costs for the return of the Products shall be at the expense of the Customer; any expenses incurred by the Customer for the return is not refundable.
Each product delivery will contain easy to follow instructions for the return of the Products.
Bagi S.r.l. agrees to promptly refund the Customer no later than 30 days from the date of the return of the Products. Bagi S.r.l. will send a confirmation email once the refund has been completed.
Bagi S.r.l. will not be responsible for reimbursement or compensation related to Products that were sent back but were never received by Bagi S.r.l. due to loss, theft or damage that are not caused by Bagi S.r.l.
If the Customer decides to modify or cancel the submitted order, he/she must promptly send an e-mail to email@example.com. Once the Product has been shipped, the order cannot be cancelled or modified until the time in which the shipped goods have been returned to Bagi S.r.l.In this case refer to the return policy above
Bagi S.r.l. aims to provide Customers with the possibility to substitute Products purchased on the Site.
To obtain the substitution of a Product the Customer must follow the steps below.
The Customer who is not fully satisfied must retain all documentation relating to the delivery and the Product itself in its original packaging and immediately contact Bagi S.r.l. by e-mail at the following address: firstname.lastname@example.org.
The Product to be replaced must be received, in normal condition, at our headquarters. The fulfillment of the new order is subject to the availability of the Products requested.
The shipping costs for returning the Product are at the expense of the Customer.
The substitute Product will be sent to the Customer via a currier with no additional shipping costs.
In case of lack of conformity of the Products sold by Bagi S.r.l. , the Customer shall immediately contact Bagi S.r.l. at the email address email@example.com of Bagi S.r.l..
The sale of products are subject to the legal guarantees provided by Articles 129, 130 and 132 of the Italian Consumer Code. The customer has the right to the restoration, without charge, of the conformity of the goods by repair or replacement, or rather to an appropriate price reduction or termination of contract. The Customer will lose said rights if he/she does not report the lack of conformity to Bagi S.r.l.within two months from the date on which he discovered the defect. The direct action to assert defects not maliciously concealed by Bagi S.r.l. must be made, in any case, within twenty-six months from the time of delivery of the good.
Information relating to the Products provided on the Website are constantly being updated.
However, it is not possible to guarantee the complete absence of errors.
Bagi S.r.l. reserves the right to correct any errors, inaccuracies or omissions even after an order has been sent as well as to change or update information at any time without prior notice.
These Terms and Conditions are governed by Italian law and shall be interpreted in accordance with Italian laws.
For disputes arising from the interpretation, validity and/or execution of the present Terms and Conditions, the mandatory territory of jurisdiction will be that of the courts of the place of residence or domicile of the consumer, if located in the Italian territory.
